Terms of Use

Apex Alloy is intended exclusively for individuals who are 18 years of age or older.

By creating an account, purchasing access to or using Apex Alloy, you represent and confirm that you are at least 18 years old.

Individuals under the age of 18 are not permitted to create an account, purchase access to or use Apex Alloy.

You must provide accurate information when creating your account.

You are responsible for maintaining the confidentiality and security of your login credentials and for activity occurring through your account unless you promptly notify us of unauthorized access.

You may not sell, transfer, rent or otherwise make your account available to another person unless expressly permitted by us.

Apex Alloy is currently offered for a one-time payment of $14.97 USD.

A successful purchase provides lifetime access to the Apex Alloy game experience associated with the purchasing user's account.

There is no recurring subscription associated with this purchase.

“Lifetime access” means access for as long as Apex Alloy continues to be made available and operated by GSC. It does not guarantee that the game, servers, technologies or every current feature will remain available indefinitely.

Lifetime access applies to the Apex Alloy game experience included with the purchase. It does not automatically include future standalone products, separately sold expansions, premium add-ons or other products that GSC may introduce in the future.

Certain beta testers, promotional users or other users may receive complimentary lifetime access without making a purchase.

Subject to these Terms, GSC grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use Apex Alloy for your personal entertainment.

Purchasing access does not transfer ownership of Apex Alloy or any associated intellectual property to you.

Apex Alloy, including its software, source code, artwork, visual elements, text, characters, worlds, names, branding, interfaces, audio, original content and other proprietary materials, is protected by applicable intellectual property laws.

Apex Alloy was created and developed by Pierre Paquette and is commercially operated by Gestion Sylvie Cousineau Inc.

Except where expressly authorized in writing, you may not copy, reproduce, distribute, sell, sublicense, reverse engineer, extract source code from, commercially exploit or create unauthorized derivative works from Apex Alloy.

You agree not to:

• interfere with the operation or security of Apex Alloy;
• attempt to gain unauthorized access to accounts, systems or servers;
• exploit bugs or vulnerabilities for unauthorized purposes;
• use unauthorized bots, scripts, cheats, automation or similar tools;
• scrape or systematically extract game content or data;
• distribute malware or harmful code;
• impersonate another person;
• use Apex Alloy for unlawful purposes; or
• infringe the rights of GSC, Pierre Paquette or any third party.

We may suspend or terminate access when we reasonably believe these Terms have been materially violated.

Payments for Apex Alloy are processed through third-party payment providers, including Stripe.

GSC does not directly store your complete credit or debit card information when payment information is processed by Stripe.

The price and currency applicable to your purchase will be displayed before checkout.

Apex Alloy is currently sold as a one-time purchase and not as a recurring subscription.

Prices may be subject to applicable taxes based on your location, billing information or other information associated with the transaction.

Where required by law, applicable taxes may be calculated and added at checkout.

Gestion Sylvie Cousineau Inc. may collect and remit taxes to the appropriate tax authorities where it has a legal obligation to do so.

Because Apex Alloy provides digital access that may become available immediately following purchase, purchases may be non-refundable except where otherwise stated or required by applicable consumer protection law.

Nothing in these Terms limits any mandatory refund or consumer protection rights that cannot legally be waived.

Certain users who participated in the Apex Alloy beta testing period have been granted complimentary lifetime access.

Complimentary access does not create a payment obligation and does not represent a Stripe purchase.

GSC may also grant complimentary access for legitimate promotional, administrative or support purposes.

Apex Alloy is an evolving digital product.

We may add, modify, rebalance, replace or remove features, content, mechanics and functionality as the game develops.

We may temporarily suspend access for maintenance, security, updates, technical issues or circumstances beyond our reasonable control.

We do not guarantee that every feature available at a particular time will remain available indefinitely.

Apex Alloy may rely on third-party providers for payment processing, hosting, authentication, analytics, email delivery, security or other infrastructure.

Your interaction with certain third-party services may also be governed by their respective terms and privacy policies.

Apex Alloy is provided on an “as is” and “as available” basis to the extent permitted by applicable law.

While we work to provide a reliable experience, we do not guarantee uninterrupted availability, error-free operation or compatibility with every device, browser, operating system or internet connection.

To the maximum extent permitted by applicable law, Gestion Sylvie Cousineau Inc. and its directors, officers, employees, contractors and representatives will not be liable for indirect, incidental, special or consequential damages arising from your use of or inability to use Apex Alloy.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

We may suspend or terminate access when reasonably necessary to protect Apex Alloy, its users, our systems or third parties or when these Terms have been materially violated.

You may stop using Apex Alloy at any time.

Termination does not automatically create a right to reimbursement except where required by applicable law.

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Any mandatory consumer rights applicable in your jurisdiction remain unaffected.

We may update these Terms as Apex Alloy evolves or as legal, technical or operational requirements change.

The updated version will display a revised “Last updated” date.

Where required by applicable law, we will provide additional notice or obtain consent before material changes take effect.
